Real Housewives of Beverly Hills alum Denise Richards is set to face off with her former landlord who she accuses of leaking her private information.
According to court documents obtained by Radar Online, a Los Angeles Superior Court judge has pushed the trial date from June 28 to December 6. The trial is expected to last 4-5 days.
The decision to push the case comes after Richards asks for a delay despite her landlord demanding the trial move forward later this month.
In January 2020, Denise and her husband Aaron Phypers were sued by their landlords, Anthony Ellrod and Christopher Masterson, who accused them of trashing a Calabasas rental home.
In 2018, the couple leased a Los Angeles home together, months before they got hitched in September.
According to their lease via Radar Online, Denise agreed that no animals would be on the property besides two pot-bellied pigs and three dogs. She also agreed to, “properly use, operate, and safeguard the property, keeping it clean and sanitary, would pay for all damage to the property caused by tenants or pets."
In the lawsuit, the landlord said the couple violated multiple terms of their lease and allowed more pets than they had agreed to on the premises.
“Almost immediately after taking possession the defendants brought numerous animals including well over a half dozen dogs and cats to the property. Not only were these animals observed by the parties, but plaintiffs’ counsel has spoken with unrelated third party witnesses who will testify to the presence of the animals and the damage they did to the property," the landlord's lawyer wrote.
He added, "During their seven month tenancy the defendants trashed the house and destroyed the landscaping, resulting in over $100,000 in damage."
The suit said Richards and her husband left the home with severe damages. The landlords demanded $113,000 to cover the repair bills. “The conduct was despicable in that it was so vile, base, contemptible, miserable, wretched, and loathsome it would be looked down upon and despised by ordinary decent people,” the suit read.
Richards and Phypers denied all allegations of wrongdoing. They filed a countersuit against the landlords. In court documents, the mother-of-three accuses the men of leaking her private information.
Denise says when they filed the lawsuit they included exhibits that included her former address, rent amount, and other private details. She scoffs at the suggestion she left the home in disarray. Richards says she kept the home in great condition. Richards said, “there are no actual damages and no actual violations of the agreement” on her part.
A source said, “Denise rented this place out for a short period of time for a family member. It was in a state of disrepair to begin with, but now the present owners, who are two lawyers, are having trouble selling it — and it is also across the street from a residential treatment program.” Richards is suing for unspecified damages for the alleged pain and suffering she suffered from the situation.
Recently, Richards asked for the trial date to be pushed to December to make sure a witness is able to testify in the case. The judge granted the motion despite the landlord's objections.
