Report: Joe Giudice Granted Opening Brief Filing Delay In Deportation Appeal!

A federal judge granted Joe Giudice, husband of The Real Housewives of New Jersey star Teresa Giudice more time to submit his opening brief to the U.S. Court of Appeals as he fights his deportation order, the North Jersey reports.

Joe was originally supposed to submit his opening brief by June 12. But the "extension of time to file opening brief" that he has been granted now moves that date back to July 15, according to court documents, as reported by the North Jersey. The motion was unopposed and granted on June 7.

The father-of-four was granted permission to continue living in the USA amid his ongoing deportation battle, according to court documents obtained by The Blast.

“The petitioner’s motion for a stay of removal is granted. The requirements for granting a stay have been satisfied. … The temporary stay of removal previously granted is vacated as no longer necessary,” the documents state. “Petitioner’s unopposed motions to seal Exhibit C to the Moseley Declaration and to amend/correct his stay motion are granted.”

“We are grateful that the Court has granted the stay,” Joe’s attorney told PEOPLE. “Joe looks forward to continuing this fight to the very end. There is nothing more important to him than returning home to his wife and kids.”

The father-of-four has been staying in "a facility in western Pennsylvania, which houses immigration detainees" since he was released from federal prison in March. His appeal to a judge's ruling last fall that he is to be deported back to Italy, where he was born, following his 41-month prison sentence, was denied in April.

However, Giudice's legal team has vowed to "continue to fight" to keep him from being deported. Joe was later granted a temporary deportation delay in federal court last month after his legal team filed for a stay.
