Gina Kirschenheiter’s Estranged Husband Matt Seeking Visitation With Kids And Pleads The Fifth In Response To Abuse Allegations!

Gina Kirschenheiter’s estranged husband is pleading with a judge to allow visitation with his kids. According to court documents obtained by The Blast, Matthew Kirschenheiter is pleading the fifth amendment in response to the Real Housewives of Orange County’s allegations of domestic abuse.

Matt's lawyer explains that he is currently facing potential criminal charges related to the incident with his estranged wife.

His lawyer then filed a divorce settlement they couple reached back in December. He is trying to enforce the agreement even after his client’s arrest. The lawyer points out that after they reached a custody deal the couple did reconcile for a period of time, reports the outlet.

Per their December agreement, they share joint legal custody and Matt has visitation. He appears to note in the documents that the kids were not in the room during the alleged altercation.

Matt is asking that his visitation not be affected by the arrest and possible criminal charges. He does offer to have monitored visitation with the court sees fit. He is asking a judge to help because he can't defend himself in the restringing order and custody case because he is now fighting a criminal case, reports The Blast.

The news comes after Gina filed a restraining order against her estranged husband, Matthew Kirschenheiter on Monday, June 24. Two days earlier, the businessman was arrested in the O.C., according to jail records. The Blast reported that Matt was arrested on suspicions relating to domestic violence. He was released on Sunday, June 23, at 1 a.m. His bail was $0.
